Requirements for outsourcing non criminal justice administration functions
relative to criminal history record information
Outsourcing is defined as a third party (contractor) performing
non-criminal justice administrative functions (document destruction,
fingerprinting of applicants, determining the suitability of the applicant based
on the fingerprint response, storage of criminal history record information
etc.) involving access to Interstate Identification Index (III) information or
access to Nevada Criminal Justice Information System (NCJIS) information.
NRS 179A.100 (4) and 28 CFR Part 906 permits the outsourcing of non-criminal
justice criminal history record checks to either another governmental agency or
a private contractor acting as an agent for the authorized receiving agency.
Responsibilities of outsourcing may include, but are not limited to: document
destruction, fingerprinting of applicants, and screening of job applicants for
employment suitability determinations. Entities wishing to outsource some or all
of their criminal history record information must be aware of the duties and
responsibilities with respect to adequate internal controls within the
contractual relationship so that the security and integrity of the III and
criminal history information are not compromised. The security program shall
include consideration of site security, dissemination and storage restrictions,
personnel security, system security, and data security. In addition, all parties
will be subject to FBI and State audits and sanctions.
All authorized receiving agencies that choose to outsource non criminal
justice administrative functions will be required to enter into a contract with
the third party (contractor) which must include the Security and Management
Control Outsourcing Standard.
